Appeals

Gourvitz & Gourvitz, LLC can handle all of your family law and related appeals involving Alimony, equitable distribution, child support, child custody, emancipation, College Contributions.

Any decision or order that is entered by the Trial Court in family law matters impact everyone involved and if you believe that your case was decided incorrectly or against all established legal principles you have a “right” to an appeal after final Judgement.

Our firm has history of success in New Jersey, New York, United States Third Circuit Court of Appeals, as it relates to appeals and has a number of reported decisions, i.e. decisions that are precedential. We have argued both before the Superior Court of New Jersey Appellate Division, the New Jersey Supreme Court, New York Appellate Division, U.S. Third Circuit Court of Appeals, as well as other tribunals.

We handle only family law related appeals including the Hague Convention, and can evaluate your case as to whether it is in your best interest to appeal and advise you on the grounds needed to appeal a particular issue. Appeals can be costly and do take a significant amount of time to be decided.  For example, all civil appeals in New Jersey have strict time limits for filing after the final judgment has been entered and the appellate process has many complex and technical requirements, making your attorney’s relevant experience in preparing and filing the brief and other documents important.

We will advise you every step of the way and counsel you on whether the decision was in our opinion incorrect given all established legal precedent, what your likelihood of success is on a particular issue, and give you a cost-effective analysis as sometimes matters are remanded back to the trial court for retrial of a particular issue.
